Use of the site

The Site provides information about the arboricultural consulting services offered by Brent Hocking Consulting Arborist. You may view it for personal, non-commercial purposes, contact us through it, and download or print content for personal reference.

You may not use the Site for any unlawful purpose; attempt to gain unauthorized access to it; interfere with its operation or security; copy, reproduce or distribute its content without permission; use automated systems to collect its data; or misrepresent your identity when contacting us.

Intellectual property

All content on the Site, including text, graphics, logos, photographs and code, belongs to Brent Hocking Consulting Arborist or its content suppliers and is protected by Canadian and international copyright law. ISA credential marks belong to the International Society of Arboriculture and are used with permission.

No professional relationship

Information on the Site is general and isn’t professional arboricultural advice. Visiting the Site or contacting us through it doesn’t create a consulting relationship. A professional engagement requires a written agreement setting out the scope of work, a site-specific assessment and acceptance of a proposal. Tree preservation requirements, bylaws, risk assessments and recommendations are site-specific, and nothing on the Site replaces a professional evaluation of your property. No warranties

We aim for accuracy but make no warranty about the completeness or accuracy of Site content, its suitability for your situation, results from our services, or whether general guidance meets a particular municipality’s requirements.

Limitation of liability

To the fullest extent permitted by law, Brent Hocking Consulting Arborist is not liable for any direct, indirect, incidental, consequential or punitive damages arising from use of, or inability to use, the Site; reliance on Site information without a formal engagement; errors or omissions in Site content; unauthorized access to your transmissions; or the actions of third-party providers.

Third-party links

The Site links to other websites for convenience. We don’t control or endorse them and aren’t responsible for their content or practices.

Professional liability

Consulting services are provided under separate written agreements with their own terms, deliverables and limitations of liability. Professional liability insurance applies only to work performed under a formal written engagement.

Indemnification

You agree to indemnify and hold harmless Brent Hocking Consulting Arborist from claims, damages, losses and expenses, including legal fees, arising from your use of the Site, your breach of these terms, your violation of third-party rights, or decisions you make based on Site information without a formal engagement.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes are subject to the exclusive jurisdiction of the courts of Ontario.

Changes and severability

We may change these terms at any time, effective when posted. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect.
